Will Smith is getting sued in a lawsuit filed by a tour musician accusing the entertainer of sexual harassment, retaliation, and wrongful termination.
New report claims tour violinist sued Will Smith for sexual harassment and wrongful termination
According to court documents reviewed by Variety, violinist Brian King Joseph is suing Will Smith and Treyball Studios Management. Joseph, a former America’s Got Talent contestant, claims Smith engaged in “predatory behavior” and “deliberately grooming and priming Mr. Joseph for further sexual exploitation” during the Based on a True Story: 2025 Tour this last spring.
The suit states Smith hired Joseph in November 2024 for a San Diego show, later inviting him to join the tour and record on an album. Joseph alleges Smith cultivated an unusually close relationship, telling him, “You and I have such a special connection that I don’t have with anyone else.”
The allegations particularly come from a March 2025 tour stop in Las Vegas. Joseph claims his bag, containing his hotel key, went missing for hours before management returned it. The suit states management was the “only individuals with access to [his] room.”
That night, Joseph says he found someone had “unlawfully” entered his room, leaving wipes, a bottle of HIV medication under another person’s name, and a cryptic note. It read, “Brian, I’ll be back no later [sic] 5:30, just us (drawn heart), Stone F.” The singer interpreted this as a warning, “an unknown individual would soon return to his room to engage in sexual acts” with him.
After reporting the incident to hotel security, police, and Smith’s team, Joseph claims a management member “shamed” him days later and terminated him, suggesting he fabricated the event. The filing claims the termination caused significant emotional distress and economic loss. He is suing for sexual harassment, wrongful termination, and retaliation, requesting a jury to determine damages. Will Smith hasn’t yet acknowledged these claims.
